INDICTMENTS ISSUED AGAINST THE FREE NATIONAL MOVEMENT ADMINISTRATION

INDICTMENT PROCLAMATION
The Servant Leadership of
The Bahamas Constitution Party
under Divine Delegated Authority and on behalf of
The People of the Commonwealth of the Bahamas
Do hereby declare the following Indictments against the
Free National Movement Administration
Whereas, the Bahamas Independence Order 1973, Chapter Five, Part 4, Article 52, subsection (1) states, "Subject to the Provision of this Constitution, Parliament may make laws for the Peace, Order and good Governance of The Bahamas”;
And Whereas, on May 10th, 2017, a General Election was held throughout the Islands of the Bahamas; and as a result, the Free National Movement won thirty-four (34) seats, capturing control of the Parliament, and was therefore given mandate to manage the affairs of the Commonwealth of the Bahamas;
And Whereas, in accordance to Chapter VI, Article 2, subsection 1, the Honourable Dr. Hubert A. Minnis was appointed by Her Excellency, the Governor-General, as the Prime Minster; and invited to form a Government, resulting in the appointment of a 19 member Cabinet;
And Whereas, in furtherance to the above stated Article, the Cabinet and all its members have collective responsibility to Parliament for the general direction and control of the Government of the Bahamas;
Therefore, in consequence, we issue these Indictments, against the Cabinet of the Free National Movement Administration for Dereliction of Duty towards the people of the Bahamas, and do therefore seek direct and immediate action and resolution regarding the same.
Indictment One (1) - Lying & Conspiracy to Deceive
During the period immediately leading up to the General Elections, the FNM Campaign team lead by Dr. Hubert Minnis, promised that no new taxes would be sought, yet the following were initiated, by Resolution or Legislation:-
a. The Increase of Value Added Tax from 7 1/2 % to 12 %
b. Several Increases in Electricity bills,
c. Proposed Increases in National Insurance
d. Increases in Airport Taxes
e. Unfair taxation to the local Gaming Industry
f. In addition to several discriminatory policies against local businesses
Indictment Two ( 2) - The Charge of Mismanagement & Corruption
Despite a Campaign on Transparency, Accountability and Integrity, contrary to Law, this FNM Administration has done the following: -
a. Provided Contracts to the companies of a sitting Cabinet Ministers' company including the exorbitant Post Office Contract;
b. Created direct Tax concessions for the businesses of sitting Cabinet Ministers;
c. Signed the $5 Billion, 600 Acres OBAN Contract with a company without experience or expertise in the industry; and signed the documents with the knowledge that Fraud was taking place;
d. Provided $60 million Government Funds for the purchase of the Grand Lucayan Hotel, with no clear plan of the way forward;
e. Allowed Industrial agreements and work relations with all Public Sector Unions to disintegrate and expire; and allowed working conditions at many public facilities to deteriorate;
f. In Addition to other incidents of impropriety, and conspiracy to defraud the Bahamian people.
Indictment Three (3) - The Charge of Criminal Negligence
Despite having adequate resources and personnel available to them, this FNM Administration was criminally negligent regarding its response and management in the aftermath of Hurricane Dorian for Abaco and Grand Bahama, shown by the following actions: -
a. First, its slow response in dispatching the Royal Bahamas Defense Force and other agencies to devastated areas to provide security to both citizens and property; and its inadequate preparation and late provision of water and life-saving supplies in Abaco, allowing many persons to die, and held under great duress within the first few days following the disastrous Hurricane;
b. Second, as a result of its failure to allow residents to identify and collect the bodies of family members who died as a result of Hurricane Dorian; it has heightened the fear and trepidation of the community of Central Abaco and Grand Bahama, which has persisted up to the present - almost five months since the souls perished;
c. Third, its neglect in providing needed assistance to indigent residents of Abaco and Grand Bahama to secure their residences: forcing many to live outdoors in tents and in substandard conditions, being exposed to the elements; while thousands more are displaced in New Providence and other islands and in the United States;
d. Fourth, its continuous provision of fraudulent information to the public regarding the amount of souls that perished and the state of the storage of those bodies; and despite consistent public outcry, its refusal to address the issues truthfully; and refusing to give a concrete and adequate timeline concerning a full resolution of the matter;
e. Fifth, its continual allowance of a Freezer Container, containing a large amount of dead bodies housed on the property of the government Public clinic in Marsh Harbour, causing unhealthy conditions to exist for residents and workers in that area: and also resulting in a continued state of fear, and heightened anxiety for the residents of Central Abaco.
Following up on the information contained in these Indictments, which are all corroborated and substantiated by electronic and print media reports; which are simply a fraction of the corrupt practices perpetrated by this Minnis lead FNM Administration; which indicates Malpractice, Gross Mismanagement, and Egregious Dereliction of duty on its part; we wish to propose the following Recommendations & Resolutions: -
Recommendation One
An extensive and forensic audit of the funds pledged and collected for Hurricane Dorian by the Government of the Bahamas, and how it was disbursed in the aftermath; Including an external audit of the National Emergency Management Agency, with specific attention to the behavior and practices of its Director, Officials and staff; for the purpose of establishing propriety or lack thereof, on the path of this Administration;
Recommendation Two
A full accounting of all remains of deceased persons that were collected in Abaco and Grand Bahama in the aftermath of Hurricane Dorian, and their whereabouts declared. This is to ensure that all remains are accounted for, identified and given to family members for burial; And / Or, that the Government itself, provide immediate burial of all remains of deceased persons, with Christian prayers made for the dead, their surviving family members.
Resolution
Therefore, in Resolution, these claims in all counts have been sufficiently substantiated, to lay such Indictments against this Free National Movement Administration which have grossly failed the mandate by which they were elected on May 10th 2017;
And whereas, this failure has directly impacted the lives and livelihoods of all Bahamians, and have increased the cost of living, and decreased the ease of doing business, and the empowerment and prosperity for the majority of its citizens;
And whereas, the mismanagement in the aftermath of Hurricane Dorian, has caused great hardship for the residents of the islands of Abaco and Grand Bahama, by failing to administer available resources and building supplies to residents, in the immediate aftermath and to date; leaving thousands still homeless, and thousands more still displaced;
And whereas, by its inhumane and unconscionable behaviour, by their disregard and disrespect for the sanctity of human life and the dead, prohibiting the families to bring closure and properly grieve; has overwhelming caused Anxiety and increased the affects of Post Dramatic Stress on the communities in Abaco and Grand Bahama, and by extension the entire Bahamas;
And whereas, all of these components placed in tandem, have created a problem for the perpetuation of Good Governance in the Commonwealth of the Bahamas; and with certainty have led to the loss of the Confidence of the majority of the Bahamian people, in this FNM Administration.
Be it therefore Resolved, that the Free National Movement Administration, led by the Most Honourable Dr. Hubert Alexander Minnis, within 90 days of the declaration of these Indictments, Tender its Resignation, and prepare the Bahamian people and the country for General Elections, in order to seek a clear mandate from the Bahamian people, on the way forward for the leadership of the Commonwealth of the Bahamas.

Seven (7) Indictments Against The PLP Government from the Bahamas Constitution
A Keynote Address by S. Ali McIntosh on March 31st, 2015 ( Full Text in attached Document)
1. The Preamble of the Constitution. FAILED. The government has failed to lead out in the values of “Self Discipline, Industry , Loyalty, Unity and an abiding respect for Christian Values and the Rule of Law"; and has failed to protect the people from Enslavement, Exploitation, Frustration and the Deprivation.
2. Principle of Democracy—The Doctrine of the Separation of Powers. FAILED. The government continues to interfere in the judiciary; making unfettered access to justice for all, almost impossible.
3. Article 52 - “Parliament must make laws for the Peace, Order and Good Governance.” FAILED
The government has Failed to legislate and implement effective policies to adequately, quash the fear of crime; Abate the criminal element, and protect the state from abuse and interference, both from within and without.
4. Articles 42, 43, 47, 48, - Qualifications for Members of Parliament and Senators. FAILED. Successive governments has failed to adequately chastise Members of Parliament, and Senators who have abused powers, and have formed shell companies and dummy corporations to protect their identity in companies who secure government contracts; and are involved in Breach of Ethics with their dealings. All transgressors should be made to RESIGN FORTHWITH.
5. Stewardship of People’s Resources - FAILED. i) Failure to Collect Revenue, ii) Failure to Tax Revenue, iii) Failure to enforce consequences on mismanagement and misappropriation of government revenues.
6. Protection of the State Sovereignty - FAILED.
Allowing the Infiltration & Annexation by the People's Republic of China to unfettered Access to Bahamian Land and Business Opportunities without Legislative authority.
7. Chapter 8 of Constitution - FAILED Relief from Duty of Persons in High Office due to Infirmity of Mind & Body. (This indictment is Seeking the Recall of the holders of the Office of Prime Minister & Other Cabinet ministers.)
